Terms of Service

These Terms of Service ("Terms") govern access to and use of the ZestRecon security operations platform and related services (the "Service"), provided by Zest Creations Technologies, LLC ("ZestRecon", "we", "us"). By creating an account or otherwise using the Service, you agree to these Terms on behalf of yourself and, if applicable, the organization you represent ("Customer").

Authorized use only

The Service is designed to assess assets and environments that Customer owns or has documented authorization to assess. Customer represents that all domains, cloud accounts, repositories, and other assets connected to or scanned through the Service are owned by Customer or that Customer has obtained appropriate authorization from the asset owner. Using the Service to assess assets without authorization is strictly prohibited and may result in immediate suspension of access.

Accounts and access

Customer is responsible for maintaining the confidentiality of account credentials and API keys, for all activity under its account, and for promptly notifying us of any suspected unauthorized access. Access within a workspace may be governed by roles Customer configures (for example, viewer, analyst, admin).

Acceptable use

• No use of the Service to attack, disrupt, or gain unauthorized access to systems outside Customer's authorized scope.
• No reverse engineering, reselling, or sublicensing the Service except as expressly permitted in a separate written agreement.
• No uploading of content that is unlawful, infringing, or that Customer does not have the right to submit.
• No interference with the security, integrity, or availability of the Service or other tenants' workspaces.

Subscriptions and billing

Paid plans are billed on the cycle and at the rates presented at signup or in an applicable order form. Fees are non-refundable except as required by law or expressly stated otherwise. We may suspend access for accounts with unresolved billing issues after reasonable notice.

Intellectual property

ZestRecon retains all rights, title, and interest in the Service, including its software, design, and underlying technology. Customer retains ownership of the data it submits to or generates within the Service ("Customer Data"). Customer grants ZestRecon a license to process Customer Data solely to provide and improve the Service.

Disclaimers

The Service is provided "as is." Security assessments reflect the scope, timing, and methods used and do not guarantee the discovery of all vulnerabilities or that assessed systems are free of risk. To the maximum extent permitted by law, we disclaim all warranties not expressly stated in a written agreement with Customer.

Limitation of liability

To the maximum extent permitted by law, ZestRecon will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from use of the Service, even if advised of the possibility of such damages.

Termination

Either party may terminate access to the Service as provided in an applicable order form or, absent one, with reasonable notice. We may suspend or terminate access immediately for a material breach of these Terms, including unauthorized scanning activity.

Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above, and continued use of the Service after changes take effect constitutes acceptance.
